A Weld County man is breathing a bit easier today after no charges have been filed because of an accusation that he kidnapped and sexually assaulted a sixteen year old girl. The district attorney who charges individuals in cities like Greeley, Erie, and Hudson could have charged him with Kidnapping (CRS 18-3-302), Unlawful Sexual Contact (CRS 18-3-404), and Menacing (CRS 18-3-206). The accusations against him arose when a sixteen year-old girl claimed that he made her get into his car where he also allegedly sexually assaulted her and then would not allow her to leave. The girl indicted over social media that she was with a man and made comments of being in distress. Her post on Facebook asked someone to call the police because she was in trouble. She said that she waited up till the man was asleep and then was able to escape.
Authorities are not buying her accusation. Because of many inconsistencies in the girl’s story, the Weld County District Attorney’s office has decided not to press charges. They retained their right to file charges in the future if an investigation provided more evidence. This case of sexual assault comes down to a classic “he said-she said” debate. This man should consider himself very lucky. Most times, society will quickly jump to the defense of a teen “victim” in a case like this without any thought of the other party involved. The sixteen year-old girl said that the man pulled her into his car and then threatened her with a gun so she would have sexual contact with him. The man insists that the girl stated she was eighteen and that no contact other than a hug occurred.
