Crazy Crime: Calling a Police Officer and Offering to Sell Him Heroin

Drugs are obviously illegal, so I would imagine most people involved in the drug world try not to get police involved. However, a woman from another state did just the opposite and her one mistaken phone call landed her in jail. This woman accidentally called a detective on his police issued cell phone and offered to sell him drugs. The detective recognized the woman’s voice from his experience with her in another criminal case, but the woman did not know who she was talking to. The officer was able to set up a drug bust and the woman was caught with heroin in her bra during the sting operation. She is now facing serious drug charges.

Unlawful Distribution, Manufacturing, Dispensing, or Sale of Heroin in Weld County

Under Colorado law C.R.S. 18-18-405 – Unlawful Distribution, Manufacturing, Dispensing, or Sale:

it is unlawful for any person knowingly to manufacture, dispense, sell, or distribute, or to possess with intent to manufacture, dispense, sell, or distribute, a controlled substance; or induce, attempt to induce, or conspire with one or more other persons, to manufacture, dispense, sell, distribute, or possess with intent to manufacture, dispense, sell, or distribute, a controlled substance; or possess one or more chemicals or supplies or equipment with intent to manufacture a controlled substance.

The fact that the woman was caught with heroin, a Schedule I substance, would have probably been a Drug Possession charge alone. But the possession coupled with the sales pitch phone call to the detective, elevates her charge to Unlawful Sale of a Controlled Substance. The penalty for this crime is based on the amount and type of controlled substance collected in Weld, Morgan and Logan County. It can be charged as a class 1, 2, 3 or 4 drug felony or class 1 drug misdemeanor.
