Greeley, Colorado Sex Offender Deregistration – How Does a Offender Get Removed From the Sex Offender Registry – C.R.S. 16-22-113?

In Greeley, after an offender is registered for the minimum number of years that are designated by their sentence in accordance to C.R.S. 16-22-113, they can petition to be removed from the SOTAR. C.R.S. 16-22-113 states:

(1) Except as otherwise provided in subsection (3) of this section, any person required to register pursuant to section 16-22-103 or whose information is required to be posted on the internet pursuant to section 16-22-111, may file a petition with the court that issued the order of judgment for the conviction that requires the person to register, for an order to discontinue the requirement for such registration or internet posting, or both.

Courts will look to see if the offender has registered for the minimum number of years, and whether they have completed sex offender treatment.  A judge will also consider any other factors bearing on the person’s risk level to reoffend sexually.

To simplify this, if an offender has been registered for the minimum amount of time, completed treatment and have not had any other sex offense convictions, they may fill out a form to discontinue Sex Offender Registration. A hearing is usually held to ensure all these requirements are met and whether anyone objects to the deregistration.
