(c) Without legal authority, carries, brings, or has in such person’s possession a firearm or any explosive, incendiary, or other dangerous device on the property of or within any building in which the chambers, galleries, or offices of the general assembly, or either house thereof, are located, or in which a legislative hearing or meeting is being or is to be conducted, or in which the official office of any member, officer, or employee of the general assembly is located.
Basically, if a person knowingly and unlawfully carries a concealed or hidden knife or firearm in Greeley, Evans, or Erie, he or she can be charged with this crime.
Exceptions to the Unlawful Possession of a Weapon
In Weld, Morgan, and Logan County, there are certain circumstances where possessing a concealed gun or knife is legal. If a person is:
- In his or her own dwelling or place of business at the time of the act of carrying; or
- On his or her own property at the time of the act of carrying; or
- In a private vehicle and carrying a weapon for lawful protection while traveling; or
- In possession of a valid written permit to carry a concealed weapon
What is the Sentence for Unlawful Possession of Weapons?
As a class 2 misdemeanor, this charge is punishable with up to 12 months in the Weld County Jail and $1,000 in fines. If the person is also a previous offender or felon, the added charge of Possession of a Weapon by a Previous Offender may apply and the sentence would be harsher since it is a felony. Any previous conviction can increase a person’s sentencing.
