Registering as a Sex Offender in Weld County FAQs Registering as a Sex Offender in Greeley

If you have been convicted of a sex offense in Weld County, Boulder County, Morgan County, or Logan County, it is a requirement that you register as a Sex Offender. Below are questions that our office frequently receives when it comes to Registering as a Sex Offender.

Where do I Register as a Sex Offender in Weld County?

When you are convicted of a sexually based crime in Colorado, you must register in the jurisdiction where you live. So, if you live in Greeley, you would need to register at the Greeley Police Station / Department. If you lived in Longmont, you would need to register at the Longmont Police Station. If you lived outside of a city's limits, then you would need to register with the Weld or Boulder County Sheriff.

In addition, some cities and towns have different restrictions for sex offenders. They can dictate which areas you can and cannot live in. Some feel more particular about sex offenders residing close to more child populated places like pools, schools and playgrounds. So, be thorough and review the city or town's municipal code before deciding where you will live.

When do I have to Register by in Greeley?

In Greeley, Boulder and any other city in Colorado, there are strict time frames put into place when people are expected to register.

A person must register or reregister:

  • Within 5 days of an out of state visit or move to Colorado
  • Within 5 days of their release from Weld County Jail or DOC with parole, probation or community corrections
  • Within 5 days of moving residences

How Often Do I Have to Register in Boulder County?

In Boulder County, and other counties across Colorado, the amount of times an offender needs to register depends on the conviction. Some offenders must re-register every 90 days (quarterly) for 20 years, and some only need to re-register once for the next 5 years. Some people must keep re-registering until their death.

Below is the list of crimes that require registration quarterly, every 90 days or every 3 months:

  • Sexual Assault - C.R.S. 18-3-402
  • Sexual Assault in the First Degree - C.R.S. 18-3-402
  • Sexual Assault in the Second Degree - C.R.S.  18-3-403
  • Sexual Assault on a Child - C.R.S. 18-3-405
  • Sexual Assault on a Child by One in a Position of Trust - C.R.S. 18-3-405.3
  • Sexual Assault on a Client by a Psychotherapist - C.R.S. 18-3-405.5
  • Incest - C.R.S. 18-6-301
  • Aggravated Incest - C.R.S. 18-6-302

If you are considered a sexually violent predator, you also have to register quarterly.

Additionally, the type of conviction received dictates how many years you will need to register in the State of Colorado.

Generally, if someone is convicted of a:

  • Class 1, 2, or 3 felony → 20 years
  • Class 4, 5, or 6 felony→ 10 years
  • Class 1 misdemeanor for sexual assault or sexual contact→ 10 years
  • Other misdemeanors→ 5 years
  • Deferred Sentence, Adjudication, or they are under 18 years old→ After they have successfully completed their sentence and / the case has been dismissed.
  • Failure to Register→ 1 year plus whatever the original time was for the underlying sexual offense

Note that these registration periods do not start until a person has successfully carried out their sentence. This is inclusive of parole and probation time. So if you get out of the Weld County Jail or DOC, and then you have to serve 1 year of parole, you would not be able to petition for deregistration until 10 years after that one year of parole is completed. Additionally, this is assuming additional sex offenses have not been committed.

If you get charged with Failure to Register as a Sex Offender, this will add on an additional felony or misdemeanor charge.
