A person who knowingly sets fire to, burns, causes to be burned, or by the use of any explosive damages or destroys, or causes to be damaged or destroyed, any property of another without his consent, other than a building or occupied structure, commits second degree arson.

Technically, by setting fire to the wife, he also caused the car to go up in flames. The fire caused damage to the woman’s car which is her property, but not a building or occupied structure. This would have been the same charge if the man had set fire to his wife’s car without her actually being present in the car. The Arson charge only applies to property in Weld, Morgan, and Logan County. Because the wife was burned in the fire, the man was charged with the Attempted First Degree Murder.
