What is Escape in Weld County?

Escape in Weld County – C.R.S. 18-8-208, is charged when a person escapes from custody or confinement while they are being held (or serving time) for a crime.  The severity of the offense is determined by the initial charge for which they were charged or convicted. For example, if a person has been convicted of a Class 1 or 2 felony (such as a second conviction of selling and distributing meth) and is serving their time in the Colorado Department of Corrections and escapes, he will be charged with a Class 2 felony, which has a sentence of 8 to 24 years in prison. If you are being held in the Weld County Jail for a felony, but haven’t been convicted, and you escape from the sheriff, you will be charged with a Class 4 felony.

Aiding Escape in Greeley, Windsor and Eaton – C.R.S. 18-8-201

If you help someone escape, you will be charged with Aiding Escape – C.R.S. 18-8-201. The lines are a bit blurry regarding the definition of “aid,” however. You will be charged if you knowingly aid, abet, or assist another person in their escape from custody. This includes allowing someone who escaped custody to stay at your house, or lending them money or a car. If the person was in custody for a Class 4 felony, you will be charged with a Class 3 felony of Aiding Escape – which is harsher than the original sentence of the person you helped.

Being charged with escape or aiding escape in Weld County can have serious consequences. In the recent escape case in Denver, the prosecutors are pushing for a 10 year prison sentence. The guard who helped him walk out of jail is set to be arraigned later this month.
