Earlier this year, a CU student was charged with Unlawful Sale of a Controlled Substance – C.R.S 18-18-405, after he sold a classmate a single prescription pill for $5. The student who bought the pill is being charged with Possession of a Controlled Substance – C.R.S. 18-18-403.5. These kinds of transactions occur often at colleges – even here in Weld County, at the University of Northern Colorado.
Punishment Does Not Fit the Crime
Prescription drugs are often traded and bought on college campuses like the University of Northern Colorado. The pill in the CU case was a stimulant used to treat ADHD, but students are known to use it as an alertness enhancer for their long hours of study. Transactions involving drugs seem small and unimportant, but they carry serious consequences. The student is facing a class 3 felony drug offense, which carries a minimum 4 years sentence to the Colorado Department of Corrections (he could spend up to 16 years in prison). Probation is also possible. This is because Unlawful Sale of a Controlled Substance is an extraordinary risk crime (which means the government believes the offense presents an extraordinary risk to society).
The War On Drugs is Unjust
The “war on drugs” sounds like a good idea to the general public. Why not get drugs off the street in Logan, Morgan and Sedgwick County? What people don’t realize is that the government institutes one-size-fits-all laws to punish drug offenders. Full-time, dangerous drug dealers are treated the same as a student who sells a $5 pill to a classmate so he can focus during study. We are treating first-time offenders (who commit small crimes) the same as drug dealers who bring all kinds of criminal activity to Greeley, Eaton and Fort Lupton. The punishment does not fit the crime, and this is unjust. It is time for a change.
