A Dirty Crime Spree | Assault on a Police Officer in Weld County

How is Assault on a Police Officer charged in Colorado?

A Colorado Springs man is facing multiple charges after a dirty crime spree. The man, who was covered in mud, broke into four homes before being caught. He began his crime bender by kicking in the front door of one home and confronting a five year old. He was able to get away from the female resident of that house, and the two subsequent houses he broke into, but on the fourth break in, he was detained by the homeowner. When police arrived, he was transported to the hospital where he attempted to escape from custody by using a chair as a weapon and assaulting a police officer. The man was not successful in his effort to escape and is in the El Paso County Jail for Assault on a Police Officer- a mandatory prison sentence crime.

First Degree Assault in Greeley

C.R.S. 18-3-202 – Assault in the First Degree – is defined by Colorado law as:

(1) A person commits the crime of assault in the first degree if:

(e) With intent to cause serious bodily injury upon the person of a peace officer, firefighter, or emergency medical service provider, he or she threatens with a deadly weapon a peace officer, firefighter, or emergency medical service provider engaged in the performance of his or her duties, and the offender knows or reasonably should know that the victim is a peace officer, firefighter, or emergency medical service provider acting in the performance of his or her duties.

Assault on a police officer does not have to result in any injury.

Different from 1st Degree Assault on a civilian victim, the assault on a police officer does not have to result in any injury. There only needs to be an intent to cause serious bodily injury to an officer to charge First Degree Assault in Greeley, Erie, and Evans. This means, in the case above, whether the officer suffered injuries or not, it was enough for the man to use the chair to try and hurt the officer. In this instance, the chair would be considered a deadly weapon because it is an object capable of producing serious bodily injury or death.

Can you image being charged with this class 3 felony in Weld, Morgan, or Logan County even though nobody got hurt? All a police officer has to say is they felt threatened and you could face 4 to 12 years in the Colorado Department of Corrections. No actual physical contact has to occur. Now, in the story above, the man did hit the police officer with the chair, but the officer did not report any serious injuries. Obviously if he was still able to stop the man from escaping he could not have been hurt too badly, yet this man is facing the same charge as someone who walked up to a man and stabbed him in the stomach with a knife.
